                LIFETIME TRADE-PRESERVATION PROGRAM POLICY


THE PRESERVATION PROGRAM IS DESIGNED TO PROTECT THE ARTIST AND PRESERVE THE HISTORIC INTEGRITY OF VALUABLE NATIVE AMERICAN AND FINE ART PIECES FOR FUTURE GENERATIONS TO ENJOY. THE NATIVE AMERICAN AND SPANISH ART PIECES SOLD AREN'T A COMMODITY BUT A ONE OF A KIND WORK OF ART BASE IN CULTURE.

AS LONG AS OUR PATRONS WHO PURCHASE ANY NUMBER WORKS OF ART  SUCH AS JEWELRY, POTTERY, SCULPTURES, PAINTINGS, THROUGH THE RANCHO CHIMAYO COLLECTION GALERIA, AND KEEP THEIR ART PIECES IN THE ORIGINAL PRISTINE CONDITION, OR THE CONDITION SOLD  SUCH AS OLDER HISTORIC PIECES, THE GALERIA WILL HONOR AND ALLOW THE PURCHASER TO TRADE UP WITH THEIR ART PIECE TO ANYTHING IN THE GALLERY THAT IS NOT ON CONSIGNMENT  AT THE ORIGINAL MARKET VALUE  AND OR THE HIGHER MARKET VALUE IF IT INCREASES.

FOR EXAMPLE: IF A PIECE PURCHASED HAD A MARKET VALUE OF $ 4,000 AT THE TIME OF PURCHASE, AND FOUR YEARS LATER INCREASES TO $ 6,000 IN VALUE, THEN THE CUSTOMER CAN USE THEIR ART PIECE IN TRADE UP FOR ANOTHER WORK OF ART AT $ 6,000, A $ 2,000 DOLLAR EQUITY INCREASE.

IT'S LIKE MONEY IN THE BANK.

IF A WORK OF ART WAS DISCOUNTED AT THE TIME OF PURCHASE,
THE ORIGINAL MARKET VALUE BEFORE THE DISCOUNT WILL BE HONORED IN TRADE,  NOT THE DISCOUNTED PURCHASE PRICE.

      FOR EXAMPLE: IF A ART PIECE THAT SOLD HAD A MARKET VALUE OF $ 4,000 AND THE GALERIA               GAVE A COURTESY PRICE OF $ 3,000, THE TRADE VALUE IS STILL $ 4,000.

THE VALUE DOESN'T DEPRECIATE BECAUSE OF A DISCOUNT. WE PUT EQUITY IN THE POCKET OF THE BUYER. THE ART PIECES AREN'T A COMMODITY. THEY ARE BASED IN CULTURE AS A ONE OF A KIND WORK OF ART.


                                            LAYAWAY POLICY

PURCHASES AT THE GALLERIES ARE POSSIBLE WITH A 50% DEPOSIT ON ART PURCAHASED AND NO INTEREST PAYMENTS ON THE BALANCE TO BE PAID OFF AS SCHEDULED  AT TIME OF TRANSACTION. THERE ARE NO REFUNDS AFTER THE REFUND GRACE PERIOD. A CREDIT WILL BE AWARDED IF THE PURCHASER CHANGES MIND AFTER 7 DAYS OF INITIAL TRANSACTION ON THE AMOUNT PAYED TOWARDS  THE INITIAL PURCHASE. THIS IS SO IN FARE NESS  TO THE ARTIST AND GALLERY SINCE THE ART PIECE WOULD BE TAKEN OFF THE MARKET FORBIDDING OTHERS FROM PURCHASING THAT SPECIFIC ART PIECE OR PIECES, THERE FOR RESULTING IN LOSS OF INCOME.

                                         COMMISSION WORK

COMMISSION WORK IS INITIATED WITH AT LEAST 1/2 DEPOSIT ON AMOUNT OF PURCHASE PRICE OR IN FULL. THE MONEY GOES INTO AN ESCROW ACCOUNT UNTIL TRANSACTION IS COMPLETE TO PAY ARTIST IN FULL  UPON COMPLETION. THERE ARE NO REFUNDS ON COMMISSION WORK. THIS IS SO BECAUSE THE ARTIST WILL HAVE COMMITTED HIM OR HERSELF TO THE TIME AND EXPENSE IN COMPLETING THE ART WORK. THE ARTIST IS PAYED 1/2 OF HIS OR HER COMMISSION ART PIECE TO INITIATE THE WORK. IF THE COMMISSIONED PIECE DOES NOT WORK OUT FOR THE PURCHASER, A CREDIT TOWARDS OTHER MERCHANDISE OF EQUAL VALUE WILL BE AWARDED TO PURCHASER FOR THE AMOUNT PAYED INTO THE COMMISSIONED PIECE OR THE ARTIST AND OR GALLERY MAY EXCHANGE ANOTHER ART PIECE WITH THE PURCHASER IF SO AGREED UPON BY ARTIST,GALLERY, AND PURCHASER. IF THE ARTIST PASSES AWAY OR REFUSES TO COMPLETE COMMISSION WORK AFTER GETTING PAYED  1/2 DEPOSIT, THEN THE GALLERY CAN ONLY REFUND THE REMAINDER OF THE BALANCE  PAYED IN ADVANCE BY PURCHASER AND WILL GIVE A CREDIT FOR MERCHANDISE  TO COVER THE REST. THE PURCHASER MUST REMAIN PATIENT DUE TO THE FACTS THAT CERTAIN ART PIECES SUCH AS POTTERY AND PAINTINGS MAY TAKE MONTHS TO COMPLETE IF ALL GOES WELL. AN EXCEPTION TO CREDIT ONLY IS IF THE ARTISTS DOES NOT COME THROUGH WITH THE ART PIECE COMMISSIONED AND AN EXCHANGE FOR OTHER ART FROM THE GALLERY.

                                             REFUND POLICY


REFUNDS ARE GIVEN ONLY WITHIN 3 DAYS  FROM THE TIME PURCHASE. AFTER THAT ALL SALES ARE FINAL.UNLESS OTHER TERMS WERE MADE AT TIME OF PURCHASE AND APPROVED  BY THE OWNER/ DIRECTOR JOSEPH SISNEROS. THE RECIEPT MUST BE PROVIDED FOR REFUND.

THE REASON WE CAN'T EXTEND THE REFUND POLICY TIME IS SO BECAUSE THE GALERIA IS RUN LIKE A NON-PROFIT ORGANIZATION  COMMITTED TO PAYING THE ARTIST AND GALLERY EXPENSES  AS QUICKLY  AS POSSIBLE AS  PART OF OUR PRESERVATION PROGRAM.

UNFORTUNATELY MOST OF OUR NATIVE AMERICAN ART AND METHODOLOGY IS BECOMMING MORE AND MORE RARE, AND IS HEADING FOR EXTINCTION.

IN MANY CASES THE ARTIST WE REPRESENT DEPEND ON THE GALERIA FOR  THEIR ONLY SOURCE OF INCOME. THEY HAVE BECOME ONLY A HANDFULL OF REPRESENTATIVES PRODUCING ANY TYPE OF TRIBLE ART. SOME PUEBLOS HAVE NO ONE MAKING ANY FORM OF POTTERY AND OTHERS PUEBLOS ARE DOWN TO LESS THEN 5 POTTERS MAKING AUTHENTIC HAND COILED PIT-FIRED POTTERY.


                                               EXCEPTIONS

THE GALERIA HAS BEEN KNOWN TO OFFER TO BUY BACK ON CERTAIN PIECES OF ART AT THE ORIGINAL PURCHACE PRICE OR AT A PRICE THAT ANOTHER COLLECTOR IS WILLING TO PAY.

THE GALERIA DOES THIS ON BEHALF OF OUR PATRONS .
THE GALERIA WILL RE SELL ART ON BEHALF OF OUR PATRONS AS PART OF OUR SERVICE AND COMMITTMENT TO OUR CUSTOMERS.
